FEDERAL UPDATE CARES Act Eviction Stay

The CARES Act provides a temporary moratorium on evictions for most residents of federally subsidized apartments, including those supported by HUD, USDA or Treasury (Low Income Housing Tax Credit developments) as well a moratorium on filings for evictions for renters in homes covered by federally-backed (FHA, Fannie Mae, and Freddie Mac) mortgages for 120 days after enactment.

If you live in a property covered by the CARES Act, landlords can now legally ask residents to leave and start charging late rent fees. But the soonest landlords can legally file an eviction to force a resident to leave is August 24, 2020.

Foreclosures

Prior to passage of the CARES Act, the Federal Housing Finance Agency (FHFA) announced that it had instructed the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation (the Enterprises) to suspend foreclosures for at least 60 days. FHFA has since announced that the Enterprises will extend the foreclosure suspension until at least August 31, 2020.

The Community Development & Housing Agency for San Bernardino County no longer offers down payment assistance. However, there are agencies who may be of assistance. Please see the Down Payment Assistance Directory for a list of resources. If you are interested in an agency on the list, please contact them directly.

Mortgage Credit Certificate (MCC) Program

While the County of San Bernardino currently does not administer a down-payment assistance program, it does participate in the statewide program known as the Mortgage Credit Certificate (MCC) Program, administered by the Golden State Finance Authority (GSFA). The MCC is used to reduce the homebuyer’s federal tax liability by providing a tax credit to their taxes which increases the mortgage amount for which a homebuyer could qualify. To participate in the MCC program, homebuyers must meet certain program requirements and must use a qualified, participating MCC lender. If you are in the process of purchasing a home, you have rights that are protected under fair housing laws.  Fair housing laws are federal mandates that ensure everyone is treated fairly during the homebuying process; they ensure persons are not subjected to discriminatory practices based upon age, race, religion, gender, and sources of income, ancestry, sexual orientation, marital status, familial status or other characteristics.
